"Keep the Linkbar ontop of other Windows"

I have this box UNchecked, yet I'm unable to keep any Windows ontop of the Linkbar.

This feature works correctly when the Linkbar is positioned on the Left, Right and Bottom of the screen but at the top of the screen..whenever a window is dragged over the Linkbar it is just snaps to the bottom of the bar.

is this how it should be? or should I be able to drag & keep windows overtop of the Linkbar?
