This cybersecurity testing platform includes powerful capabilities that, if misused, can result in:

  • Criminal prosecution
  • Civil liability
  • Significant financial penalties
  • Imprisonment

YOU MUST UNDERSTAND AND ACCEPT THESE TERMS BEFORE PROCEEDING.


1. Acceptance of Terms

By accessing, downloading, installing, or using the Cybersecurity Agent platform (the "Software"), you ("User", "you", or "your") agree to be bound by these Terms of Use. If you do not agree to these terms, YOU MUST NOT USE THIS SOFTWARE.

1.1 Explicit Acceptance Required

Before accessing any functionality of this Software, you must:

  1. Read and understand these complete Terms of Use
  2. Read and understand the Responsible Use Guidelines (RESPONSIBLE_USE.md)
  3. Provide explicit written acceptance
  4. Acknowledge that you understand the legal implications
  5. Agree to comply with all applicable laws and regulations

2. Legal Framework & Compliance

2.1 Authorization Requirement

Warning

CRITICAL: AUTHORIZATION IS MANDATORY

You MUST NEVER use this Software to test, scan, access, or interact with:

  • Computer systems you do not own
  • Networks you do not own or operate
  • Applications you are not authorized to test
  • WiFi networks you do not own or have explicit permission to test
  • Any infrastructure without EXPLICIT WRITTEN AUTHORIZATION

"Authorization" means:

  • Written permission from the system/network owner
  • A signed penetration testing agreement
  • Legal contract specifying the scope of testing
  • Official work assignment from your employer (if testing company assets)

2.2 Applicable Laws

Use of this Software must comply with ALL applicable laws, including but not limited to:

United States:

  • Computer Fraud and Abuse Act (CFAA) - 18 U.S.C. § 1030
  • Electronic Communications Privacy Act (ECPA)
  • Wiretap Act - 18 U.S.C. § 2511
  • State-specific computer crime laws

European Union:

  • General Data Protection Regulation (GDPR)
  • Network and Information Security Directive (NIS Directive)
  • Computer Misuse Act (UK)
  • National cybercrime laws of member states

Other Jurisdictions:

  • Canada: Criminal Code Section 342.1 (Unauthorized use of computer)
  • Australia: Cybercrime Act 2001
  • All local, state, and national laws in your jurisdiction

2.3 Prohibited Activities

The following activities are STRICTLY PROHIBITED:

  1. Unauthorized Access: Accessing any system without explicit permission
  2. WiFi Interception: Intercepting WiFi communications without authorization
  3. Deauthentication Attacks: Performing deauth attacks on networks you don't own
  4. Data Theft: Extracting, copying, or exfiltrating unauthorized data
  5. Denial of Service: Overwhelming systems to cause unavailability
  6. Exploit Usage: Using exploits against unauthorized targets
  7. Credential Theft: Capturing or harvesting credentials without permission
  8. Malware Deployment: Installing malicious software on unauthorized systems
  9. Pivoting: Using compromised systems to attack other systems
  10. Social Engineering: Manipulating individuals to gain unauthorized access

3. User Responsibilities

3.1 Due Diligence

You are responsible for:

  1. Verifying authorization before every scan or test
  2. Maintaining documentation of all authorizations
  3. Understanding the scope of your authorization
  4. Staying within boundaries specified in authorization documents
  5. Immediately stopping if you exceed your authorization
  6. Reporting any issues to appropriate parties

3.2 Record Keeping

You MUST maintain records of:

  • All authorization documents
  • Dates and times of all testing activities
  • Targets tested
  • Tools and techniques used
  • Findings discovered
  • Actions taken

These records may be required for legal defense if your activities are questioned.

3.3 Responsible Disclosure

If you discover vulnerabilities using this Software, you MUST:

  1. Do NOT exploit the vulnerability beyond proof-of-concept
  2. Do NOT disclose publicly before coordinating with the affected party
  3. Contact the organization privately and securely
  4. Provide reasonable time for remediation (typically 90 days)
  5. Follow coordinated disclosure practices
  6. Document the disclosure process

4. WiFi Testing - Special Legal Notice

Caution

WiFi TESTING CARRIES SIGNIFICANT LEGAL RISKS

4.1 WiFi-Specific Laws

In many jurisdictions, the following activities are CRIMINAL OFFENSES:

  • Intercepting WiFi communications (even unencrypted)
  • Deauthentication attacks (forcibly disconnecting clients)
  • Packet injection (sending crafted WiFi frames)
  • WPA/WPA2 cracking (attempting to recover passwords)
  • Evil twin attacks (creating fake access points)
  • Man-in-the-middle attacks on WiFi

4.2 WiFi Authorization Requirements

To legally test WiFi networks, you MUST:

  1. Own the network (it's your personal/business network), OR
  2. Have written authorization from the network owner
  3. Understand local laws regarding WiFi testing
  4. Test only specified networks in your authorization
  5. Do NOT test neighbor networks, public WiFi, or other networks

4.3 Legal Precedents

Users have been prosecuted for WiFi-related activities in multiple jurisdictions:

  • Using neighbors' WiFi without permission (theft of services)
  • Intercepting WiFi communications (wiretapping violations)
  • Deauthentication attacks (denial of service / computer fraud)

DO NOT assume that testing your own WiFi network is always legal - check local laws.


5. Liability & Disclaimers

5.1 Use at Your Own Risk

THIS SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

You acknowledge and agree that:

  1. You assume all risks associated with using this Software
  2. The developers are not responsible for your actions
  3. You are solely liable for any damages or legal consequences
  4. No legal advice is provided by this Software or its creators

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Developers, contributors, and distributors of this Software SHALL NOT BE LIABLE for any damages arising from your use
  • This includes direct, indirect, incidental, consequential, or punitive damages
  • This includes criminal prosecution, civil lawsuits, or regulatory enforcement
  • You WAIVE ALL CLAIMS against the developers for your misuse of this Software

5.3 Indemnification

You agree to INDEMNIFY and HOLD HARMLESS the developers, contributors, and all affiliated parties from:

  • Any claims arising from your use of this Software
  • Legal fees and costs
  • Regulatory fines or penalties
  • Damages awarded to third parties

6. Software Capabilities & Features

6.1 Designed Purpose

This Software is designed for:

  • Authorized security assessments
  • Penetration testing with permission
  • Security research in controlled environments
  • Educational purposes with proper authorization
  • Compliance auditing of owned systems

6.2 Audit Logging

This Software maintains comprehensive audit logs of all activities, including:

  • User identification
  • Actions performed
  • Targets accessed
  • Timestamps
  • Authorization documentation references
  • Results obtained

These logs may be subpoenaed in legal proceedings.

6.3 Kill Switch

This Software includes an emergency kill switch that:

  • Immediately terminates all operations
  • Closes all network connections
  • Saves current state
  • Generates an incident report
  • Locks the system pending review

Use the kill switch if you suspect unauthorized activity or legal issues.


7. Account & Organization

7.1 User Accounts

By creating an account:

  1. You certify that all information provided is accurate
  2. You are at least 18 years old
  3. You have legal authority to bind yourself to these terms
  4. You will not share your account credentials
  5. You will notify us immediately of any unauthorized use

7.2 Organization Accounts

Organizations using this Software must:

  1. Designate authorized users
  2. Maintain authorization documentation
  3. Implement access controls
  4. Conduct regular compliance audits
  5. Train users on legal requirements

7.3 Authorization System

This Software includes a live authorization pulse check that:

  • Verifies user authorization every 5 minutes
  • Checks with a central authorization server
  • Revokes access if authorization is withdrawn
  • Logs all authorization checks

Your access can be immediately revoked without notice.


8. Data Privacy

8.1 Data Collection

This Software collects:

  • User account information

10. Termination

  8. ✅ You understand audit logs are maintained and may be disclosed to authorities
  9. ✅ You waive all claims against the developers for your misuse
  10. ✅ You agree to indemnify the developers for any claims arising from your use

Unauthorized computer access is a serious crime. Penalties can include:

  • Federal prosecution (up to 20 years imprisonment)
  • Heavy fines ($250,000+ for individuals, $500,000+ for organizations)
  • Civil lawsuits with substantial damages
