| 6 | +THE SOFTWARE GRAPHICS ARTWORK TO YOU ONLY UPON THE CONDITION THAT YOU |
| 7 | +ACCEPT ALL OF THE TERMS CONTAINED IN THIS LICENSE AGREEMENT |
| 8 | +("AGREEMENT"). PLEASE READ THE AGREEMENT CAREFULLY. BY USING THE |
| 9 | +SOFTWARE GRAPHICS ARTWORK, YOU ACKNOWLEDGE THAT YOU HAVE READ THE TERMS |
| 10 | +AND AGREE TO THEM. IF YOU ARE AGREEING TO THESE TERMS ON BEHALF OF A |

| 18 | +and conditions of this agreement, Oracle grants you, the individual or |
| 19 | +entity a non-exclusive, non-transferable, royalty-free, limited right to |
| 20 | +use, reproduce, display or distribute this software graphics artwork, as |
| 21 | +individual graphics or as a collection, as part of software code or |
| 22 | +programs that you develop, provided that i) this license and the |
| 23 | +copyright notice above accompany the software graphics artwork; and ii) |
| 24 | +you do not utilize the software graphics artwork in a manner that is |
| 25 | +disparaging to Oracle. Unless the enforcement of a restriction against |
| 26 | +modification is prohibited by applicable law, you may not modify the |
| 27 | +graphics, and must use them true to color and unmodified in every way. |

| 29 | +The software graphics artwork is subject to copyright. Title to the |
| 30 | +software graphics artwork and all associated intellectual property |
| 31 | +rights is retained by Oracle and/or its licensors. |

| 34 | +of any kind. ORACLE FURTHER DISCLAIMS ALL WARRANTIES, EXPRESS AND |
| 35 | +IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF |
| 36 | +MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.** |

| 38 | +**IN NO EVENT WILL ORACLE OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, |

| 47 | +This agreement is effective until terminated. You may terminate this |
| 48 | +agreement at any time by ceasing all use of the software graphics |
| 49 | +artwork. This agreement will terminate immediately without notice from |
| 50 | +Oracle if you fail to comply with any provision of this agreement. |
| 51 | +Either of us may terminate this agreement immediately should the |
| 52 | +software graphics artwork become, or in either party’s opinion, be |
| 53 | +likely to become, the subject of a claim of infringement of any |
| 54 | +intellectual property right. Upon termination, you will promptly cease |
| 55 | +using the software graphics artwork. If any term of this agreement is |
| 56 | +found to be invalid or unenforceable, the remaining terms will remain |
| 57 | +effective, and such term will be replaced by a term consistent with the |
| 58 | +purpose and intent of this agreement. |

| 60 | +You represent and warrant that you have not in any way unilaterally |
| 61 | +modified the terms of this agreement as provided by Oracle. |
| 62 | + |
| 63 | +This agreement is governed by the substantive and procedural laws of the |
| 64 | +state of California and controlling U.S. federal law and you and Oracle |
| 65 | +agree to submit to the exclusive jurisdiction of, and venue in, the |
| 66 | +courts in San Francisco or Santa Clara counties, California, in any |
| 67 | +dispute arising out of or relating to this agreement. |

| 69 | +This agreement is our complete agreement for your use of the software |
| 70 | +graphics artwork, and this agreement supersedes all prior or |
| 71 | +contemporaneous agreements or representations, written or oral, |
| 72 | +regarding the software graphics artwork. |
