Thank you for contributing to malmo. This Contributor License Agreement ("Agreement") sets out the terms under which you contribute to the malmo project (the "Project"). It exists so that the Project can be stewarded responsibly over time while guaranteeing — in writing — that the Project always remains open source.
You keep ownership of your work. This is a license, not an assignment of copyright. You grant the Steward broad rights so the Project can be maintained, licensed, and relicensed as needed, and in return the Steward makes a binding promise that the Project stays open (Section 5).
By agreeing to this Agreement — by signing it, by accepting it through an automated contributor-agreement tool, or by confirming your agreement in writing (including by email) — you accept the following terms for your past, present, and future Contributions to the Project.
- "Steward" means Andrei Onel, the maintainer of the Project, and his successors and assigns.
- "You" (or "Your") means the individual or legal entity agreeing to this Agreement. If you are agreeing on behalf of an entity, you represent that you are authorized to bind that entity.
- "Contribution" means any original work of authorship — including any modifications or additions to existing work, and any associated documentation — that You intentionally submit to the Project, in any form and through any medium (including code, pull requests, patches, issues, and electronic communication), whether before or after the date You agree to this Agreement.
- "Submit" means any form of communication sent to the Project or its maintainers, excluding communication that You conspicuously mark in writing as "Not a Contribution."
You grant to the Steward — and to recipients of software distributed by the Steward — a perpetual, worldwide, non-exclusive, royalty-free, irrevocable copyright license to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, distribute, and otherwise use Your Contributions and such derivative works, under any license terms the Steward chooses, subject to the covenant in Section 5.
This includes the right to relicense the Project, and to license the Project under more than one set of terms in parallel.
You grant to the Steward — and to recipients of software distributed by the Steward — a perpetual, worldwide, non-exclusive, royalty-free, irrevocable (except as stated in this Section) patent license to make, have made, use, offer to sell, sell, import, and otherwise transfer Your Contribution, where such license applies only to those patent claims licensable by You that are necessarily infringed by Your Contribution alone or by combination of Your Contribution with the Project to which it was Submitted.
If any entity institutes patent litigation against You or any other entity alleging that Your Contribution, or the Project to which You contributed, constitutes direct or contributory patent infringement, then any patent licenses granted to that entity under this Agreement for that Contribution or Project shall terminate as of the date such litigation is filed.
You retain all right, title, and interest in and to Your Contributions. Nothing in this Agreement restricts You from using, licensing, or otherwise exploiting Your Contributions for any purpose. The licenses You grant in Sections 2 and 3 are non-exclusive.
In consideration of the rights You grant above, the Steward covenants that the Project, including Your Contributions, will at all times remain available to the public under at least one license approved by the Open Source Initiative (https://opensource.org/licenses). As of Version 1.0 of this Agreement, that license is the GNU Affero General Public License, version 3 (AGPL-3.0).
This covenant guarantees that the Project can never be taken fully closed-source. It does not restrict the Steward from additionally offering the Project, or any Contributions, under other license terms in parallel (for example, to grant a partner an exception) — provided an OSI-approved open source license always remains available to the public.
You represent that:
- Each of Your Contributions is Your original creation, or You otherwise have the right to grant the licenses in this Agreement.
- To the best of Your knowledge, Your Contributions do not violate the intellectual property rights of any third party.
- If Your employer has rights to intellectual property You create, You have either received permission to make the Contributions on behalf of that employer, or Your employer has waived such rights for Your Contributions to the Project.
You are not expected to provide support for Your Contributions, and You provide Your Contributions on an "AS IS" basis, without warranties of any kind, except as stated in this Section.
This Agreement applies to all of Your Contributions, including any You Submitted to the Project before the date You agree to this Agreement. By agreeing, You confirm that the terms above apply retroactively to those prior Contributions.
The Steward is under no obligation to use or incorporate any Contribution. This Agreement is governed by the laws of Ireland, without regard to its conflict-of-laws principles. If any provision is held unenforceable, the remaining provisions remain in effect. This Agreement is the entire agreement between You and the Steward regarding Your Contributions and supersedes any prior agreement on that subject.
How to agree: sign this document, accept it through the Project's automated contributor-agreement tool, or reply in writing (including by email) stating that you agree to malmo Contributor License Agreement Version 1.0, including for your prior Contributions.
