This agreement ("Agreement") is entered into between the Texas Justice Initiative ("TJI") and any individual(s) (a "Recipient") who downloads or accesses any data from TJI’s website (the "Datasets" as described more fully herein).
TJI developed and owns the Datasets on its website, which represent a collection and curation of data and information gathered from various governmental agencies related to Texas criminal justice issues. TJI is willing to grant Recipient access to the Dataset on the following terms:
By downloading or accessing any Datasets, you hereby agree to all of the terms specified in this license. TJI grants Recipient the limited right to use the Datasets only for the Recipient’s own academic, nonprofit, and research purposes. The Recipient may not use TJI’s Datasets for any commercial or profit-making purpose; and may only use the Dataset in accordance with this Agreement. TJI retains all rights, title, and interest in and to the Dataset, and does not grant any rights in the Dataset other than as specified herein.
When using TJI Datasets in any reports, articles, papers, journals or other mediums you must document and give TJI appropriate credit, provide a link to TJI’s website, and specifically indicate what, if any, changes were made to the Datasets. You may do so in any reasonable manner, but you may not in any way suggest that TJI endorses you or your use of its Datasets.
Recipient acknowledges that the Datasets are the proprietary information of TJI. The Recipient also agrees to protect the Dataset from unauthorized access or use. The Recipient agrees not to use or distribute any of the Datasets in any form, electronic or otherwise, except as expressly permitted by this Agreement.
Recipient shall defend, indemnify, release, and hold TJI harmless from and against any and all claims, losses, damages, and expenses arising out of their use of or access to any of the Datasets, including, without limitation, those arising from Recipient’s negligence or breach of any of the terms of this Agreement. This provision will survive the expiration or termination of this Agreement.
The Dataset is provided "as is." TJI disclaims any and all warranties of any kind with respect to the Dataset, and the Recipient hereby releases TJI from liability and waives any and all claims it may have against TJI in connection with Recipient’s use of the Dataset. The Recipient may not assign its rights under this Agreement without the prior express written permission of TJI. This Agreement represents the entire agreement of the parties with respect to the subject matter hereof. Texas law governs this Agreement and the state or federal courts in Texas will have jurisdiction over disputes arising from this Agreement.
